TpDream11 is an online gaming platform. TpDream11, through its website and related mobile applications (together referred to as "Platform"), offers a wide variety of online slots games, poker games, casino games, casual games, sports-based games, and other skill-based games. These Terms of Service for TpDream11 ("Terms") along with TpDream11’s Privacy Policy ("Privacy Policy"), and the Fair Play Policy ("Fair Play Policy"), govern the relationship between the users ("You") and Us. The Terms, Privacy Policy, the Fair Play Policy, and the cumulative set of Game Rules (together "Platform Policies") form a binding legal agreement between You and TpDream11, on the basis of which You may visit, access, or use the Platform and related services offered by Us ("Services").
Your use of the Services indicates your acceptance of the Platform Policies and hence you are advised to read the Terms carefully before using Our Services.
We reserve the right to periodically review, update, or otherwise modify any part of the Platform Policies at our sole and absolute discretion, and accordingly, you are advised to keep yourself updated on the latest Platform Policies. We will provide you with notice of any modification to the Terms, and your continued access and use of the Services after such notification shall constitute consent to the modified Platform Policies.
If you do not accept any part of the Platform Policies or any subsequent modification therein, you must stop accessing or using our services.
To use the services and play on the platform, you must register with Us and consent to the Platform Policies.
In the event where one or more of the terms hereunder are determined to be invalid or unlawful for any reason, by a competent judicial or quasi-judicial authority in India, the validity or enforceability of the remaining terms will not be affected and the same will be valid and binding on you and all other users.

Who may use Our Services:

1.1 In order to use the Services, a User must register for a user account ("Account"), and truthfully and accurately provide all mandatory information. In order to participate in our games, you must satisfy the following criteria at all times:
You must be at least 18 years old, and must not suffer from any disability or impairment which would prevent you from assuming the responsibilities contained in the Agreement, or from participating in the Games which are offered as part of the Services.
You must be a resident of India.
You must access the Services while located within the Eligible Territory.
You need possess a valid PAN number, which will be associated with your Account and which you will provide to us upon request.
You must satisfy yourself that it is legal for you to participate in Games in the specific jurisdiction from which you are accessing the Services.
1.2 You understand and acknowledge that participation in Games may result in loss to you, and agree that your participation is completely voluntary. You undertake full responsibility for any such losses, and agree that you will not under any circumstances hold the Platform responsible for such losses.
1.3 You understand and accept that by viewing or using the Site or availing of any Services, or using communication features on the Site, you may be exposed to content posted by other Users which you may find offensive, objectionable or indecent. You may bring such content posted by other Users to our notice that you may find offensive, objectionable or indecent and we reserve the right to act upon it as we may deem fit. The decision taken by us in this regard shall be final and binding on you.

How can You access and/or use the Service:

2.1 HappyAce allows You to play Games with other registered users on the Platform. All games that are made available on the Platform are games of skill (the outcome of the game is primarily dependent upon Your skills and not luck or chance). Therefore, it is legal to play these games in most states in India.
2.2 You can play the Games offered on the Platform only via the HappyAce website and mobile application, which can be downloaded or installed from the Google Play Store for Android users, and Apple’s App Store for iOS users or such other app stores.
2.3 When You access Our Services and/or create a HappyAce Account, We may collect, use, share with third parties, store, or otherwise process Your information, which may include Your personal information and sensitive personal information, to ensure that the Services may be accessed and used by You efficiently. The collection, use, sharing of such information is governed by the Privacy Policy which forms an integral part of the Platform Policies. You may access the Privacy Policy.
2.4 At the time You register with Us, You are required to verify Your mobile number for playing any of the Games offered on our Platform. This is to safeguard against fraud of any form at HappyAce. All Your information is kept confidential and processed as per Our Privacy Policy.
2.5 When You register with Us, You agree to receive promotional messages from Us, and our affiliates, through SMS, Email, Call and Push Notifications, in relation to Tournaments, offers, and Discounts (of various types and nomenclature e.g. bonus). You may withdraw Your consent to receive such notification by sending an email to game.tpdream11@gmail.com
2.6 Internet connectivity issues at Your end, disruptions due to Your local internet environment, errors in the setup of software or hardware on Your end, or other factors not directly attributable to Us, are beyond Our control, and accordingly, We will not incur any liability for any halts, breaks, or interruptions in Your usage of Our Services on account of such issues.
2.7 Winnings, Discounts, and prizes whether monetary or non-monetary are unique to each player and are non-transferable. In the event You attempt to transfer any winnings, discounts, or prizes, these will be forfeited at Our sole discretion.
2.8 The rules of all activities in the game must be adhered to, and all activities, discounts, and other information are subject to the game.

User Identity:

3.1 When you register with Us, You choose Your username which shall be your identity ("Username") on the Platform. Your chosen username is confirmed, subject to availability and in compliance with these Terms.
3.2 You are prohibited from creating or using multiple Usernames and/or accounts on our Platform. If multiple User IDs and/or accounts are detected for one user, we may take penal actions, including cancellation of all amounts related to Discounts on linked Username and/or accounts, and suspension of the linked User IDs and/or accounts.
3.3 Username must not be indecent, objectionable, offensive, or unlawful. Username that are found to violate the intellectual property of any entity, reveal personal information, or be suggestive of an advertising or promotional activity, may be rejected. Users in violation of these stipulations will be given an opportunity to provide an alternate Username failing which We reserve the right to either terminate Your TpDream11 Account or restore Your TpDream11 Account only after an acceptable User name has been provided by You.

Severability and Waiver

If any provisions of these Terms are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these, which shall remain in full force and effect. No waiver of any term of these Terms shall be permitted.

Governing Law and Jurisdiction

These Terms shall be governed by and interpreted and construed in accordance with the laws of India as applicable between resident Indians. Subject to the dispute resolution term below, any disputes pertaining to the App shall be subject to the exclusive jurisdiction of the appropriate courts of Bengaluru, India.

Dispute Resolution

All disputes arising from or in connection with these Terms shall be settled amicably between the parties within 30 days, failing which it shall be referred to and finally settled by arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996 as amended from time to time, presided over by a sole arbitrator appointed mutually appointed by the Parties failing which it shall be appointed by the High Court of Bengaluru. Judgment upon the arbitral award may be entered in any court having jurisdiction over the Parties. The arbitration proceedings shall be held at Bengaluru. The arbitration proceedings shall be conducted in the English language.
